1. Who this agreement is between
These Terms of Service ("Terms") are between you ("you," "Client") and LocalCraft Digital, an Illinois sole proprietorship operating from Edwardsville, IL ("LocalCraft Digital," "we," "us"). By purchasing a plan, signing in to a client dashboard, or using the website at localcraftdigital.com, you agree to these Terms.
2. What we provide
LocalCraft Digital builds and operates marketing websites for local businesses. Four plans:
- Flat Build, $7,997 one-time. A complete custom multi-page website built and delivered within 48 hours of the green-light intake. After delivery, you own the site outright. No ongoing relationship is required.
- Care Plan, $3,997 setup + $197/month. A complete custom multi-page website, plus hosting, SSL, daily backups, quarterly SEO, AEO, GEO, and performance optimization, performance reports, the client portal, and two hours of update work each month, published within 24 hours. The two hours are per calendar month, and unused time does not roll over. Update work past two hours in the same month is billed at $150 per hour. Section 2a defines what counts as an update request and how the time is measured.
- Craft Plan, $3,997 setup + $497/month. Everything in the Care Plan, plus unlimited new pages and sections, unlimited content updates published within 24 hours, and monthly rather than quarterly optimization. There is no hourly cap and no hourly rate on the Craft Plan.
- Grow Plan, $3,997 setup + $997/month. Everything in the Craft Plan, plus one piece of weekly original SEO, AEO, and GEO content, a real-time lead dashboard, ongoing AEO maintenance, and ZIP-and-category exclusivity in your market.
Monthly fees on the Care, Craft, and Grow Plans are auto-charged to your payment method on the same date each month. Section 4 covers billing.
2a. What counts as an update request, and how the two hours are measured
This section matters on the Care Plan, where included time is capped. On the Craft and Grow Plans, content updates and new pages and sections are unlimited, and nothing below meters them.
An update request is one change, or one batch of related changes, that you ask for in writing by emailing support@localcraftdigital.com or by submitting it in the client portal. Typical requests: edit the copy on a page, swap photos, change your hours or service areas, add a staff bio, update pricing, add or remove a service on an existing page, fix a broken link, adjust a form, publish a post you wrote.
How the time is counted:
- Per calendar month. The two hours reset at 12:00 a.m. Central on the first of each month, regardless of what date your subscription renews. Unused time does not carry into the next month.
- We count the work itself, not the clock. What counts is hands-on production time: editing, building, testing, and publishing. Reading your request, replying to it, quoting it, and the normal back-and-forth about it are not counted.
- Rounded to the nearest 15 minutes per request, with a 15-minute minimum on any request that changes the site.
- No surprise overage. Tell us at any time and we will say how much of the month you have used. Before we start work that would go past the two hours, we tell you and wait for your go-ahead. You are never billed at the hourly rate for work you did not approve.
- What never counts against your hours: hosting, SSL, backups, security patches, uptime work, the optimization pass, your performance report, portal access, and any remedy work under section 6.
Some work is not an update request: a brand-new page, a new section on an existing page, a redesign, a new feature, an integration, or a migration. On the Care Plan we quote that work separately at $150 per hour. On the Craft and Grow Plans, new pages and sections are included.
3. Build timeline
The 48-hour build clock starts when the intake form is submitted in full. It pauses if we need information from you and resumes when you provide it. Delivery is to a private staging URL; you have a 7-day window to request one round of revisions before the site goes live on your domain.
4. Payments and billing
- Stripe handles all payments. Card details never touch LocalCraft Digital's servers. By submitting payment you also agree to Stripe's Terms.
- Monthly plan fees auto-charge to your card on file. This covers every monthly tier: Care, Craft, and Grow. It is a recurring subscription. We do not offer manual invoice-pay for monthly fees; the only billing model is automatic charge.
- Separately accepted website payment plans. If your checkout includes a website down payment or installment schedule, the client-specific Payment Plan Addendum shown and accepted before payment controls that website balance. Website installments are separate from the cancellable monthly service fee and remain due until paid, even if the related Care service is later canceled, unless the addendum or a later written agreement signed by both parties says otherwise.
- Failed payments. If a charge fails, Stripe will retry on a standard schedule. If it continues to fail beyond 14 days, we may pause service until the balance is current.
- Price changes. The prices listed above are our current list prices, and we may change them at any time. What governs your purchase is the price shown on your checkout page at the moment you pay, not the list price on this page. If you were quoted a price before a change, that quoted price is what you check out at. Once you are a subscriber, your monthly rate is locked at the rate you signed up at until you cancel, regardless of later increases.
- Plan contents are locked too, and that lock is permanent. We may change what a plan includes, not only what it costs. A change like that applies to people who subscribe after it takes effect. For as long as you stay subscribed without interruption, you keep the plan contents that were in effect on the date you signed up, even if we later meter, reduce, or reorganize that plan for new customers. This is not a grace period and it does not expire. Said plainly for the clients it affects: if your plan included unlimited update requests on the day you subscribed, it still includes unlimited update requests, and it will for as long as you stay on that plan. Moving to a different plan is a new decision, so the plan you move to carries the contents that plan has on the day you move. Cancelling ends the lock; if you subscribe again later, you subscribe to the plan as it exists at that time.
5. Cancellation
You may cancel any monthly service plan at any time, with no cancellation fee, by calling (314) 246-9224 or emailing support@localcraftdigital.com. Cancellation is by phone or email only. This lets us understand why and either fix what isn't working or close out cleanly. Your service runs through the end of your current billing period; you are not charged the next monthly service fee. If you separately accepted a website Payment Plan Addendum, canceling Care or another service does not cancel, accelerate, waive, or otherwise change the unpaid website balance; that addendum controls the remaining website payments.
Included update time ends with the plan. The two hours on a Care Plan are per calendar month and do not roll over, so there is never an accumulated balance to settle at the end. Time you have not used in your final month is not refunded, not credited toward the final invoice, and not paid out or transferred in any other form, and no earlier month leaves a balance behind either. If you have time left, use it before your period closes; we publish that work on the same 24-hour turnaround.
On cancellation, you keep the site files when the website project price has been paid in full. We provide a free export of code, content, and assets within 7 days of cancellation or final website payment, whichever is later. If a separately accepted Payment Plan Addendum still has an unpaid website balance, its ownership, export, payment, and default provisions control. After 30 days without an active hosting or service relationship, we may take the live site offline from our hosting.
6. Build and ongoing optimization
We build your site to convert visitors into calls and inquiries, and we continue to refine and optimize it until it is doing its job. If your site is not pulling its weight, the remedy is continued work on the website until it is. The remedy is always continued work; it is never a cash refund or money-back of any kind. That remedy work sits outside your plan's included hours. It does not count against the two hours on a Care Plan, it is never billed at the $150 hourly rate, and it does not reduce the update work you can ask for that month. You never spend your own included time on our under-delivery. For reporting, a "lead" is the metric we show in your dashboard and your monthly report. A lead is a real inquiry: a form submission with valid contact details that clears spam filtering, or a phone-link, email-link, or text-link tap (counted once per visitor per channel per day), measured in standard web analytics. That figure is a reporting metric only and is not a guaranteed number. Results depend on factors outside the website itself, including your market, your offer, your pricing, and how you follow up on the inquiries the site generates. To raise a concern, email support@localcraftdigital.com and we will review your reporting data together and keep working on the site.
7. Site ownership
You own the content, images, and copy you provide. LocalCraft Digital owns the underlying templates, design system, and build infrastructure (the "Build Framework") and grants you a perpetual, royalty-free license to use the Build Framework as compiled into your site. When the website project price has been paid in full, cancellation includes delivery of the static source code; if a separately accepted Payment Plan Addendum still has an unpaid website balance, that addendum controls ownership, export timing, and payment. The Build Framework license remains in effect for use of that specific site after delivery.
8. Your responsibilities
- Provide accurate business information, content, photos, and any third-party access (Google Business Profile, social accounts, domain registrar) we need.
- Keep your payment method current.
- Do not use your site to host or promote anything illegal, infringing, defamatory, deceptive, sexually explicit, violent, or that violates a third-party right.
- Do not attempt to circumvent our tracking pixel, copy our Build Framework into another site without permission, or share dashboard credentials beyond your business.
9. What we do not do
LocalCraft Digital is not your legal, tax, medical, financial, or compliance advisor. Site copy is provided for marketing; you are responsible for the accuracy of claims you make about your own business, including pricing, services, hours, licensing, certifications, and any regulated industry disclosures.
10. Suspension and termination by us
We may suspend or terminate service if you breach these Terms, fail to pay after a 14-day grace period, abuse our staff, or use the site for content prohibited under section 8. If we terminate for cause, no refund is owed for the current billing period. If we terminate for any other reason, we pro-rate your monthly fee back to you.
11. Limitation of liability
LocalCraft Digital is liable to you for direct damages only, and only up to the total amount you have paid us in the 12 months preceding the claim. We are not liable for lost profits, lost data, lost goodwill, indirect, consequential, special, incidental, exemplary, or punitive damages, even if advised of the possibility. This clause survives termination.
12. Warranty disclaimer
Your site is provided "as is" and "as available." We disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) to the maximum extent allowed by law. We do not warrant that the site will be uninterrupted, error-free, or that all defects will be corrected, though we work to keep uptime as high as reasonably possible.
13. Indemnification
You agree to defend, indemnify, and hold harmless LocalCraft Digital from any claim arising out of (a) content you supply to us, (b) your use of the site to operate your business, or (c) your breach of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Madison County, Illinois, and you consent to that venue. You waive any right to bring a claim as a class action.
15. Changes to these Terms
We may update these Terms. If a change is material, we will notify you by email at least 30 days before it takes effect. Material means anything affecting your rights, including a price change for existing subscribers, a change to what a plan includes for someone already subscribed to it, a change to how included time is counted or capped, a change to the build-and-ongoing-optimization commitment in section 6, and changes to cancellation, liability, or acceptable use. Remember that the scope lock in section 4 protects you here: a change to what a plan includes applies to people who subscribe after it takes effect, not to you. Continued use of the service after the effective date is acceptance of the updated Terms.
